14/09/1999: All Parties Should be Accountable for Niah Bloodshed
Bintulu, Tuesday:- The Treasurer General of Sarawak National Party (SNAP) Dato' Tiong King Sing was disappointed after learning many complaints and crititicisms published in the daily newspaper regarding to the recent tragedy in the estate plantation.

The problem on the land ownership issue in Ulu Niah has resulted in a bloody outcome, which in Tiong's opinion, all parties should be accountable for the bloodshed; that is the company as well as the residents.

In addition too, Tiong said a `third party' who lhave been manipulating this issue for their organisation agenda to gain popularity.

He said, all parties involved should compromise in a peaceful in a peaceful and civilised ways in order for the matter to be solved amicably and achieved a win-win situation.

`Anyone who is sincere in assisting to resolve this matter shoudld not be doing so for his or her own interest, but to take into account of all parties involved'

Dato' Tiong said in any similar venture, all parties involved have to sacrifice and nobody should have the whole cake and eat it.

According to him, he understood the company and longhouse residents had already organised several discussion and meetings to reach mutual agreement in resolving the said dispute.

There were several occasion, he revealed that even though both parties had mutually agreed on some matters, however the residents had changed their minds the following day.

It was believed that a "third party" had poisoned their minds by telling the residents not to agree to the understanding, so that they could pressurize the company as well as the government to fight for their total entitlement.

This "third party" also had been provocating the residents to "fight" for their rights against the company, government or anyone, he said.

`Indirectly, the " third party" was leading the residents to take the law into their own hands'

Tiong said the said party knew all along that by manipulating the issue, they would create misunderstanding which would result 
 

 in a havoc situation.

`They can then use the issue for their personal gain at the expense of innocent human lives and using the resident as their shield'

Why should we blame the police who had procedures when taken action, Tiong stressed.

He said all aware that it was difficult for the police to take action when the complaining party did not have the legal ownership of the properties.

Through his observation, he believed that in a situation similar to the particular one, the dissastified party should approach the matter by filing a civil suit to claim loss or damages, provided if there was a basis.

He said, they might apply a court injunction through the high court instead of trying to provoke the residents to take the law into their hands.

`Logically, what can the Police do if there are no proper documentation regarding the ownership of the land from the legal point of view'

Even though there was a claim that the Native Court had made a decision favouring the resident, but to Tiong's knowledge the Native Court only applies to disputes or claims among the natives only.

The police force carried out their duties based on evidence and in this situation, he said no concrete evidence in terms of the land ownership could be seen.

On the other hand, he said they should leave it to the police to investigate and gather sufficient evidence and to prosecute the suspects in the court of law.

`Overally, I sincerely believe that  we should thank and give a pat on the back to the police force for their untiring services rendered'

He said, all can witness that our country is a safe place to live and work!

However, Tiong said he was so disppointed with the opposition for their short sighted approach.  

`The opposition always like to critise and blaming on other people'

He said as a civilised nation, we are able to handle the current situation without having to fight amongst each other.
 
Tiong said the nation had learnt from the past that we did not gain anything by criticising and blaming each other in solving any kind of problems.

Lastly, he urged everyone to be calm and to refrain from making accusation, provacation and blaming others on this matter.

`Believe me, we are not helping anyone by doing so'
